We Have A NO Spam Policy
We have a No SPAM policy and if you feel you have received a text message unsolicited on your mobile phone please email us all details or you may call (310) 441-3771. You will be immediately taken off any list and the message partner that created the text will be notified and suspended if an improper action caused the SPAM. You can stop any message service to your phone by replying STOP to the message received.
We try to eliminate mobile SPAM by requiring all mobile text message services to have an opt-in reply message for each different campaign. This requires a User to be in control of the mobile phone and reply YES or Y to start any text service. Anyone can opt-out at any time by replying with the word STOP to a message. Our partners are also required to sign a contract which specifies the conditions of SPAM and that their accounts will be suspended or canceled if they violate this agreement.

MessageBall is a service of Copyright © 2010 Company28, LLC. All Rights Reserved. and provides a service which allows any one to start a mobile text message campaign. All Users of this service agree to operate under the terms of their contract and these Terms of Service.
MessageBall may at times change these Terms of Service or improve or alter the actual services provided, at its sole discretion and will not be held liable to any User for any costs or expenses that occur directly or indirectly as a result of any change.
MessageBall will not sell, and will not knowingly disclose, its Clients customer lists or customer email or mobile phone numbers. (although it cannot guarantee that such information will never be found out).
Transmission of data over the Internet is not completely secure. It may be possible for third parties to intercept or access transmissions or data unlawfully. MessageBall will make reasonable efforts to protect your Personal Information, we cannot ensure or warrant the security of any information you or your customers transmit or store with us. Any such transmission is done at your own risk. MessageBall will make reasonable efforts to protect Clients information from theft, misuse and alteration.
It is your responsibility to understand the Terms of Use for any MessageBall partner as they keep and maintain their own database of information and they may have different ways in which the use your data.
MessageBall may suspend its service to make repairs or maintenance updates and will use best efforts to inform all Users.
Any person or entity that abuses their privileges at MessageBall may be suspended or canceled at the sole discretion of MessageBall.
MessageBall will stop any service if the order has come from a regulatory agency.
A User agrees that they will not use any MessageBall service for any unlawful, improper, immoral or fraudulent purpose.
A User agrees to not transmit any material that is offensive, abusive, defamatory, obscene or menacing or infringes the rights of any other person or entity.
Every MessageBall partner agrees to clearly post the cost of their services and a statement that makes clear that some text messages have costs from a mobile carrier.
It is clearly understood that MessageBall owns all rights to the technology and intellectual property that is used to deliver mobile text messages, including but not limited to any patents, know-how, registered or unregistered trademarks, design right or copyright or other intellectual property right, in respect of the Services.
A User agrees not to cause or permit any person to decompile, reverse-engineer or disassemble all or any part of any software or other processing material used by MessageBall in the provision of the Services.
A User may not sell, lend or assign their account to any other third party, doing so will cause and automatic cancellation of their services with no refund for service.
The User shall be solely responsible to MessageBall for its use of the MessageBall Service and for the content of data and text messages sent to End Users and shall indemnify and hold harmless MessageBall against any damages, losses, costs, expenses or claims made by third parties arising out of any such use or content. In particular, but without limitation, the User shall be solely responsible for obtaining authorization of relevant third parties to use of any content and for paying all relevant royalties and other license fees in respect of same. The User shall indemnify and hold harmless MessageBall against any damages, losses, costs, expenses or claims made by any third party arising from the sending of any content via a text Message.
Every User also has a Services Contract which contains additional information regarding the rights and responsibilities of a User and MessageBall. This Contract is provided when you sign up for service.
